Map 3 and the Scheme Clauses of the Amendment Scheme are filed at the Offices of the Local Municipality of Madibeng and are available for inspection during normal office hours.   The Amendment is known as Hartbeespoort Amendment Scheme 1/507 and shall come into operation on the date of this Notice.   Municipal Manager Local Municipality of Madibeng    CONDITIONS OF ESTABLISHMENT      TOWNSHIP MELODIE EXTENSION 30      STATEMENT OF CONDITIONS UNDER WHICH THE APPLICATION MADE BY ACW INVESTMENTS    PROPRIETARY LIMITED (2017/198073/07) (HEREINAFTER REFERRED TO AS THE TOWNSHIP    APPLICANT), ACCORDING TO THE PROVISIONS OF PART 3 CHAPTER C OF THE TOWN PLANNING    AND TOWNSHIPS ORDINANCE, 1986 (ORDINANCE 15 OF 1986) FOR PERMISSION TO ESTABLISH    A TOWNSHIP ON PORTION 72 OF THE FARM HARMONIE 486-JQ (PREVIOUSLY KNOWN AS    HOLDING 77 MELODIE AGRICULTURAL HOLDINGS), NORTHWEST PROVINCE HAS BEEN    GRANTED     1. CONDITIONS TO BE COMPLIED WITH PRIOR TO THE DECLARATION OF THE TOWNSHIP AS    AN APPROVED TOWNSHIP      1.1 CANCELLARION OF EXISTING CONDITIONS OF TITLE     The applicant shall at its own expense cause any restrictive conditions (if any) to be cancelled or the township area to be freed therefrom.    1.2 PROVISION AND INSTALLATION OF SERVICES     The applicant shall make the necessary arrangements with the local authority for the provision and installation of water, electricity, sanitation and refuse removal as well as roads and stormwater drainage in and for the township, for which purpose a mutually acceptable services agreement   between the local authority and the applicant shall be concluded.    1.3 GENERAL     a) The applicant shall satisfy the local authority that -   i) The relevant amendment scheme in terms of section 125 of the Town-Planning and Townships Ordinance, 1986 is in order and can be published simultaneously with the declaration of the township as an approved township;   ii) That an entrance to the town and public street system to all the erven in the town are available;   iii) That the consent from the Department of Agriculture, Conservation and Environmental Conservation Act has been obtained and that all conditions imposed shall be complied with;   b) The applicant shall comply with the provisions of sections 72 , 75 and 101 of the Town-Planning and Townships, 1986    2. CONDITIONS OF ESTABLISHMENT     2.1  NAME    The name of the township shall be  Melodie Extension 30 .   2.2  DESIGN    The township shall consist of erven and streets as indicated on  General Plan 10092/2007 .   2.3  DISPOSAL OF EXISTING CONDITIONS OF TITLE    All erven shall be made subject to existing conditions and servitudes, if any.   2.4  FORMATION, DUTIES AND RESPONSIBILITIES OF THE OWNERS ASSOCIATION    The township owner shall provide proof to the local authority that a homeowners association has been properly and legally constituted in terms of Section 21 of the Companies Act before the   transfer of the first erf.   2.5  RE-LOCATION AND/OR REMOVAL OF TELKOM SERVICES    Should Telkom services be affected in any way by the development, the removal or re-location of such services shall be done by and at the expense of the applicant.    3. CONDITIONS OF TITLE      CONDITIONS IMPOSED BY THE LOCAL AUTHORITY IN TERMS OF THE TOWN-PLANNING NAD    TOWNSHIPS ORDINACE, 1986    3.1  ALL ERVEN    (a) The erf is subject to a servitude, 2m wide, in favor of the local authority for sewerage and other municipal purposes, along any two boundaries other than a street boundary and in the case of a panhandle erf, and additional servitude for municipal purposes 2m wide across the access portion of the erf, is and when required by the local authority; provided that the local authority may dispense with any servitude by the consideration of building plans.   (b) No other building or other structure shall be erected within the aforesaid servitude area and no large-rooted tress shall be planted within the area of such servitude or within 2m thereof.   (c) The local authority shall be entitled to deposit temporarily on the land adjoining the aforesaid servitude such material as may be excavated by it during the course of the construction, maintenance or removal of such sewerage mains and other works as it, in its discretion may deem necessary and shall further be entitled to reasonable access to the said land for the aforesaid purpose subject to any damage done during the process of the construction, maintenance or removal of such sewerage mains and other works being made by the local authority.    4. CONDITIONS TO BE INCORPORATED IN THE TOWN-PLANNING SCHEME IN TERMS OF    SECTION 125 OF THE ORDINANCE 15 OF 1986, IN ADDITION TO THE PROVISIONS OF THE    TOWN-PLANNING SCHEME IN OPERATION     4.1  GENERAL CONDITIONS (APPLICABLE TO ALL ERVEN)    (a) If required, a soil report, drawn up by a qualified person acceptable to the local authority, indication the soil conditions of the erf and recommendations as to suitable founding and depths shall be submitted to the local authority simultaneously with the submission of building plans prior to the commencement of any building operations on the erf.   4.2  ERVEN 898 AND 899     USE ZONE 2  RESIDENTIAL 2     The erf shall be used solely for the purposes of dwelling units and ancillary community facilities, subject to the following conditions    (a) The height of buildings shall not exceed 2 storeys. (b) The density shall not exceed 40 units per hectare.   (c) Parking shall be provided according to Table G of the Hartbeespoort Town Planning Scheme, 1993.   (d) A site development plan compiled by a person suitably qualified to the satisfaction of the local authority shall be submitted to the local authority for approval prior to the submission of building plans.   (e) Building lines, etc. shall be according to the approval of the site development plan. (f) All parts of the erf upon which motor vehicles are allowed to park or move shall be provided   with a permanent dust free surface, which surface shall be paved, drained, and maintained to the satisfaction of the local authority.
