The explanatory summary of the Amendment Bill is hereby published in accordance with Rule 241(1) (c)  of the Rules of the National Assembly.   The purpose of the Amendment Bill is to give effect to the Constitutional Court decision in  New Nation Movement NPC & others v President of the Republic of South Africa &    others [2020] ZACC 11 , which declared the Electoral Act, 1998 (Act No. 73 of 1998) (the Act ) unconstitutional to the extent that it requires that adult citizens may only be elected to the National Assembly and Provincial Legislatures only through their membership of political parties.   The Amendment Bill seeks to make provision for the election of independent candidates to the National Assembly and provincial legislatures and to provide for matters connected therewith.
